The Regular Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive.   Invocation was given by Shane Browning.   Roll call was taken and a quorum was established with all Magistrates being present.  

APPROVAL OF MINUTES: September 3, 2013 minutes - Motion by Magistrate Toney and seconded by Magistrate Welch to approve the September 3, 2013 minutes. Motion carried.  

REPORT OF COUNTY ATTORNEY: Nothing to report.

REPORT OF TREASURER:  A) General Fund in the amount of $81054.96; Road Fund in the amount of $17502.38; Jail Fund in the amount of $58513.01; LGEA Fund in the amount of $24176.55, Total all Funds $181246.90. Department Reports: Jeff Browning, Road Foreman stated that Saturday, September 21, 2013 is the day set for the Household Hazardous Waste Collection Day.

 

The State had notified Hopkins County Fiscal Court that the Otter Lake Dam needed to be mowed and cleaned up. The Road Department and the Hopkins County Jail’s Road Crew had cleaned the Dam.   Magistrate Larry Wilson stated that he had gotten a call in the area the both crews had done a remarkable job.  

 

Mosquito Spraying has been done and is continuing to be done in other areas in the County. The costs of chemicals for the mosquito spraying has been costly and that this should be a separate line item in next year’s budget.

 

Report of Magistrates/Committee: Magistrate Toney stated the Recreation Building and Grounds Committee has met to discuss the renovation portion of the old courthouse for the Central Dispatch.   Motion to approve the costs of renovation to be paid by the 911 funds and not to exceed $150,000.00 was approved by Magistrate Toney and seconded by Magistrate Maurice Wilson. Motion carried.

NEW BUSINESS: A) Approve 2013 Extension District Rates - Motion to approve by Magistrate Beshears and seconded by Magistrate Roberts. Motion carried.

 

B) Pauper Burial – Bandy Funeral Home - Motion to approve the pauper burial and payment of $500.00 to Bandy Funeral Home by Magistrate Toney and seconded by Magistrate Groves. Motion carried.

 

C) Resolution 2013-10 and Agreement between Commonwealth of Kentucky, Transportation Cabinet & Hopkins County Fiscal Court – Rural Secondary Funds in the amount of $260,051.00. Motion to approve Resolution 2013-10 and agreement by Magistrate Welch and seconded by Magistrate Larry Wilson. Motion carried.

 

D) Approve Bids for Demolition Clean-up – Lowest Bids

Motion to approve Demolition Bids by Magistrate Welch and seconded by Magistrate Toney. Motion carried.

 

E) Accept Bids for Surplus Vehicles Highest Bids:

APPROVAL OF MINUTES: November 5, 2013 minutes - Motion by Magistrate Maurice Wilson and seconded by Magistrate Toney to approve the November 5, 2013 minutes. Motion carried.  

November 13, 2013 minutes – Motion by Magistrate Groves and seconded by Magistrate Welch to approve the November 13, 2013 minutes. Motion carried.

REPORT OF COUNTY ATTORNEY: County Attorney Todd P’Pool gave an update on the annexation for the South Hopkins Volunteer Fire Districts. A petition was delivered to the County Attorney’s office with the proposed boundaries to annex their Fire District territories.  

 

Magistrate Karol Welch thanked anybody that is helping in this matter.

D) Retirement: Senate Bill 2 talks about Pension Spiking which is defined when an employee from one year to the next has an increase of 10% in pay.   Retirement used to be figured at the high five.   Senate Bill 2 states no more allowing an increase to help retirement and if so the County will have to pay the difference. Employees need to understand when an elected official is going out of office they reward employees with an increase so this will not be allowed.   Sick leave will no longer be applied to retirement for anyone hired after January 1, 2013.   Part-time employees do not participate in retirement.

NEW BUSINESS: A) Franchise Agreement – Time Warner Cable Midwest LLC Motion to approve agreement by Magistrate Roberts and seconded by Magistrate Toney. Motion carried.

 

B) Franchise Agreement – Insight Communications Motion to approve agreement by Magistrate Toney and seconded by Magistrate Welch.

Motion carried.

 

C) Memorandum of Agreement – Hopkins County Fiscal Court and Commonwealth of Kentucky’s Finance and Administration Cabinet. GIS Kim Ezell explained that this would be a partner with the State to purchase the data.   Motion to approve agreement by Magistrate Larry Wilson and seconded by Magistrate Groves to approve the Memorandum of Agreement. Motion carried.

 

D) Proposed Deed from Hopkins County Fiscal Court to Hopkins County Board of Education for the Anton School. In 1949 the School System deeded the Anton School to Hopkins County Fiscal Court. The Fiscal Court then issued the bonds and the bonds were paid off in approximately 1962 however the property was never deeded back to the school system.   Motion to approve Judge Executive to sign the Deed on behalf of the Fiscal Court by Magistrate Larry Wilson and seconded by Magistrate Toney. Motion carried.

REPORT OF COUNTY ATTORNEY: County Attorney, Todd P’Pool thanked the Court for accepting the Maintenance Agreement on McElvain Road and stated he would present the agreement to Countrymark.

REPORT OF JAILER:  Not Present.

REPORT OF TREASURER:  A) Request to re-write the check to the Governor’s Minority Program to Madisonville Community College due to the fact that Governor’s Minority Program not having an account to deposit the check in. Motion to approve this request by Magistrate Larry Wilson and seconded by Magistrate Toney. Motion carried.

 

Payment of Claims: General Fund in the amount of $49761.42; Road Fund in the amount of $80068.42; Jail Fund in the amount of $12174.56; LGEA Fund in the amount of $96452.31, Total all Funds $238456.71. Motion to approve payment of claims by Magistrate Toney and seconded by Magistrate Welch. Motion carried.

 

B) Benefits – Life insurance benefit at $50,000.00 will costs approximately $9000.00 more a year with Anthem. Current life insurance benefit is 25,000.00 per employee. Magistrate Wilson would like to revisit life insurance – Hopkins County has approximately 157 employees.

 

Febco is the current flexible spending company.   McGregor & Associates is a company that will offer flexible spending and Health Savings Account at the same company.   Motion to accept McGregor & Associates by Magistrate Larry Wilson and seconded by Magistrate Welch. Motion carried.

 

Treasurer, Cindy Jones stated in the past Hopkins County has allowed employees to have a Health Savings Account at any bank.   Recommendation that all employees are allowed to choose where Health Savings Accounts are held but the money will only be payroll deducted for deposit to an account held at McGregor & Associates. In the event an employee wants HSA account somewhere besides McGregor & Associates it will be each employee’s responsibility to fund the account. Motion to approve by Magistrates Toney and seconded by Magistrate Welch. Motion carried.

Report of Magistrates/Committee: Magistrate Toney asked if the Contract with Associated Engineers concerning the Sports Complex had been received. County Attorney Todd P’Pool stated contract was received and reviewed by his office and submitted to Judge Carroll for his signature.

NEW BUSINESS A) Ken Robinson & Judge Executive Rick Newman & Ken Gibson – Paradise Regional Park – Hopkins County is a member of the five county multi park board. The Multi County park was funded by multi county coal severance dollars and is located on approximately 375 acres at the Graham exit on WK parkway. The park is proposing to build a concrete pad that would accommodate a 100,000 square feet building. The Pad would cost approximately $130,000.00.   Paradise board has passed a resolution to support the pad and is asking the Counties of 17% of the costs which is approximately $21,000.00 – This building would be built right off the parkway.   Sewer and water has been installed on the property. Muhlenberg County is going to do the work. The Revenue Stream will be shared with participating counties.  

 

County Attorney would like to applaud the vision of this regional approach and the material is very impressive and stated that this is a 501C 3 corporation.   Motion by Magistrate Roberts and seconded by Magistrate Toney to pay the $21000.00. Motion carried.    

 

B) Second Reading of Ordinance 2013-3 - AN ORDINANCE OF HOPKINS COUNTY, KENTUCKY, RELATING TO THE 2013 TAX RATES at the rate of 14.40 cents per one hundred FOR REAL PROPERTY IN HOPKINS COUNTY, KENTUCKY. Motion to approve Second Reading of Ordinance 2013-3 by Magistrate Toney and seconded by Magistrate Welch.

Frank Wright – EMA Director had several missing persons in the last month. Several problems with County Sirens – something is wrong with the repeater or central dispatch. EMA will be doing some tests today. New communication vehicle is here if you would like to tour it.

NEW BUSINESS A) Appoint Roger Cunningham to Earlington Fire Protection Board of Directors. Motion to approve by Magistrate Welch and seconded by Magistrate Groves. Motion carried.

 

B) Resolution 2013-11- Resolution requesting the Kentucky General Assembly re-consider legislative expenditures taken from coal severance tax revenues and seriously consider changing the formula to return more of the severance tax directly to the general funds of coal producing counties through the Local Government Economic Assistance Fund until the crisis subsides.   Motion to approve Resolution 2013-11 by Magistrate Larry Wilson and seconded by Magistrate Beshears. Motion carried.

Grievances from citizens: Shane Browning spoke to the court about the Fundraising of the Sports Complex.   Would like the process to be lifted from the table position and just do the fundraising process. Contract presented is a guarantee to raise our fee. Recreation Building & Grounds committee will meet on November 5th to discuss this.
