HOPKINS COUNTY FISCAL COURT
REGULAR MEETING
GOVERNMENT CENTER
July 16, 2013 at 10:00 a.m.

The Regular Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive.   Invocation was given by County Attorney Todd P’Pool.   Roll call was taken and a quorum was established with all Magistrates being present except for Magistrate Maurice Wilson.  

APPROVAL OF MINUTES:  June 25, 2013 minutes - Motion by Magistrate Beshears and seconded by Magistrate Welch to approve the June 25, 2013 minutes.  Motion carried.   

REPORT OF COUNTY ATTORNEY:  Minerals underneath an abandoned cemetery - County Attorney recommends Judge Carroll to sign the Coal Lease Agreement between Hopkins County, Kentucky for property formerly owned by the Mt. Zion Methodist Episcopal Church South pursuant to KRS 273.130 and Alliance Resource Properties.  Motion to approve this agreement by Magistrate Roberts and seconded by Magistrate Beshears and authorizing Judge Carroll to sign this agreement.  

REPORT OF COUNTY CLERK:   Nothing to report.

REPORT OF SHERIFF:  A) Approval 2012 Real Property, Oil & Gas Settlement.  Motion to approve by Magistrate Beshears and seconded by Magistrate Larry Wilson.  Motion carried.

B) Approval 2012 Public Service / Franchise Tax Settlement Motion to approve by Magistrate Larry Wilson and seconded by Magistrate Beshears.  Motion carried.

REPORT OF JAILER:  Nothing to report.

REPORT OF TREASURER:  A) Transfers:  Motion to approve Transfers by Magistrate Larry Wilson and seconded by Magistrate Beshears.  Motion carried.

  1. Payment of Claims General Fund in the amount of $393038.49; Road Fund in the amount of $191945.69; Jail Fund in the amount of $198519.38; LGEA Fund in the amount of $284673.29, Total all Funds $1068176.85.  Motion to approve the payment of claims presented by the Treasurer except the payment of $56,329.30 to Associated Engineers by Magistrate Toney and seconded by Magistrate Roberts.   Motion carried.

Judge Carroll asked if we can do this since we have to pay bills within 30 days.  County Attorney stated that it was a proper motion.   Magistrate Welch would like it clarified why this bill is not being paid.  Magistrate Toney stated that without a proper contract we cannot see the scope of the agreement.   All magistrates voted in favor except Magistrate Larry Wilson who opposed the motion.    Motion carried.

  1. Treasurer’s Report Motion to approve by Magistrate Toney and seconded by Magistrate Groves.  Motion carried.
  2. Financial Statement Motion to approve by Magistrate Toney and seconded by Magistrate Welch.  Motion carried.
  3. Financial Reconcilement 7/2012 – 6/2013 Motion to approve by Magistrate Larry Wilson and seconded by Magistrate Toney.  Motion carried.

Department Reports:  None

Report of Magistrates/Committee:  Recreation, Building & Grounds Committee met to discuss the Archery building.  Motion to approve bidding process for Archery building, Plumbing, HVAC and Electrical by Magistrate Toney and seconded by Magistrate Larry Wilson.  Motion carried.

Transportation Committee met with Brian Ruffin about replacing a 2002 model truck with approximately 230,000 miles with a 2014 Ford F550 for approximately $41,995.00 with State Contract from Crossroads Ford.  Also purchase a 12 foot flat bed with 2 under bed tool boxes at the estimated costs of $11,553.15; Starley Hydraulic Power Unit with hoses and adapter at the estimated costs of $9,685.65; Aluminum Sign racks at approximate costs of $8,758.48; Telescopic Platform at an estimated costs of $8,758.48; Telescopic Platform at an estimated costs of $3900.00; Champion 3500 watt Generator at an estimated costs of $366.00; and miscellaneous equipment, tool boxes, 2 way radio, and lights at an estimated costs of $3,000.00.  Also replace 200,000 mile dump truck – bid out for a 2013 dump truck.  Motion to approve bids and equipment purchases by Magistrate Roberts and seconded by Magistrate Beshears.  Motion carried.

NEW BUSINESS: A) Resolution 2013-3 – Resolution Madisonville Splash Park Motion to approve by Magistrate Roberts and seconded by Magistrate Toney.   

Magistrate Beshears stated that he felt other projects in the county that rank higher – Library, Communication System not compliant with – YAA needs money.   Magistrate Roberts stated that this project was already allocated for another city project and that didn’t work out so he felt City should still receive the money.

B) Resolution 2013-5 – Amending Resolution 2012-18 Coal Severance Funds - Motion to approve by Magistrate L. Wilson and seconded by Magistrate Groves.  Motion carried.

C) Resolution 2013-06 – Resolution Homeland Security Interoperative Voice Communication System Project - Motion to approve by Magistrate Beshears and seconded by Magistrate L. Wilson. All in favor except Magistrate Toney, who opposed the Resolution.   Motion carried.

D) Approval Health Department Tax Rates Motion to approve rate of 3.9 cents per $100.00 by Magistrate Beshears and seconded by Magistrate Groves.  Motion carried.

E) Humane Society Lease to Hopkins County for 1.00 per year.  Magistrate Roberts made a motion to approve the lease and seconded by Magistrate Toney.  Motion carried.

Grievances from citizens:   Scott Rogers discussed the Library and the funding provided by the County.   

Adjournment: Motion to adjourn by Magistrate Roberts and seconded by Magistrate Toney.   Motion carried.
