HOPKINS COUNTY FISCAL COURT

SPECIAL MEETING

GOVERNMENT CENTER

NOVEMBER 13, 2013 at 9:00 a.m.

The Special Called Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive.   Invocation was given by Magistrate Larry Wilson.   Roll call was taken and a quorum was established with all Magistrates being present except Magistrate Shaun Roberts.  

NEW BUSINESS: A) Resolution 2013-13 – Resolution of Agency Transferring from Non-Hazardous to Hazardous Coverage as defined by KRS 61.592 (1) (b) – Motion to approve by Magistrate Maurice Wilson and seconded by Magistrate Groves. Discussion: Magistrate Larry Wilson asked Sheriff Latham what employees will follow under the Hazardous Coverage and Sheriff Latham stated it was the sworn full service deputies; this does not include part-time Court Bailiffs and office staff.

 

B) Employee Benefits:   Discussion about Flexible spending – New employees must wait 60 days after employment for flexible spending to begin. Motion by Magistrate Larry Wilson and seconded by Magistrate Toney to approve the waiting of 60 days after employment for flexible spending to begin at the first of the month following the 60 days.   Motion carried.

 

The Balance in flexible spending as of December 31 of each year will revert back to the County. Motion to approve the rule “if you don’t use it you lose it” for the flexible spending balance of December 31 of each year by Magistrate Larry Wilson and seconded by Magistrate Welch. Motion carried.

  

Adjournment: Motion to adjourn by Magistrate Larry Wilson and seconded by Magistrate Maurice Wilson.    Motion carried.

The Regular Called Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive.   Invocation was given by County Attorney Todd P’Pool.   Roll call was taken and a quorum was established with all Magistrates being present except for Magistrate Roberts.  

APPROVAL OF MINUTES: November 19, 2013 minutes - Motion by Magistrate Beshears and seconded by Magistrate Maurice Wilson to approve the November 19, 2013 minutes. Motion carried.  

REPORT OF COUNTY ATTORNEY: County Attorney stated that he had inspected McElvain & Ashbyburg Roads.   These roads are being damaged by trucks hauling on the roads. Countrymark is hauling on McElvain continuously and is expecting an offer to be presented at the next Fiscal Court meeting.

Magistrate Karol Welch thanked anybody that is helping in this matter.  

 

REPORT OF COUNTY CLERK:  Nothing to report.

REPORT OF SHERIFF: 2014 Fee Account Budget – Motion to approve by Magistrate Welch and seconded by Magistrate Groves. Motion carried.

REPORT OF JAILER: Nothing to report.  

REPORT OF TREASURER:  A) Transfers: Motion to approve by Magistrate Welch and seconded by Magistrate Larry Wilson. Motion carried.

 

B) Payment of Claims: General Fund in the amount of $20895.90; Road Fund in the amount of $68982.93; Jail Fund in the amount of $16188.68; LGEA Fund in the amount of $103489.22, Total all Funds $209556.73. Motion to approve payment of claims by Magistrate Beshears and seconded by Magistrate Toney. Motion carried.

 

Department Reports: Mike Duncan stated Courthouse Renovation is still being done and should be completed after the first of the year.

 

Report of Magistrates/Committee: Magistrate Toney gave the Court a report on the Food Drive that was held over the past weekend.

 

Magistrate Larry Wilson made a motion to loan the Hopkins County - Madisonville Public Library Board of Trustees the sum of $500,000.00 to finish renovation at 245 E. Center Street, Madisonville, Kentucky. This motion was seconded by Magistrate Toney. All magistrates being in favor - Motion carried. County Attorney stated a contract should be prepared and Magistrate Larry Wilson stated that Cindy Jones and Kim Blue would draft an agreement and send to his office for approval.  

 

Old Business: None

NEW BUSINESS: A) Surplus Furniture and Fixtures from Courthouse. Motion to approve to surplus the furniture and fixtures by Magistrate Larry Wilson and seconded by Magistrate Welch. Motion carried.

 

B) Appointment of Beverly Caricco and Scott Wells to Hopkins County Extension District Board. Motion to approve the appointments by Magistrate Beshears and seconded by Magistrate Toney. Motion carried.

 

C) Bryan Anderson has requested to fill the vacant office of Hopkins County Constable in the 5th District. Motion to approve by Magistrate Toney and seconded by Magistrate Welch. Motion carried.

Grievances from citizens: Lee Lingo invited the Court to attend the Kentucky Chamber 2014 Legislative Preview Conference in Lexington, Kentucky on December 9, 2013.

APPROVAL OF MINUTES: September 17, 2013 minutes - Motion by Magistrate Beshears and seconded by Magistrate Maurice Wilson to approve the September 17, 2013 minutes. Motion carried.  

REPORT OF COUNTY ATTORNEY: Carolyn Foster was in court regarding the citizens of the south end of Hopkins County who has fire protection from Mannington Fire District which is out of Hopkins County area. These individuals have received notice that the insurance rates are going up. These individuals have signed a petition to have them in the Hopkins County area but the Mannington Fire District will not agree to release them from its district. County Attorney stated he will take necessary steps to get them back in the Hopkins County Fire District. Captain Darwin Rideout and Blake Vaughn were also in attendance.

 

REPORT OF COUNTY CLERK: Tax bills went out on time.  

REPORT OF SHERIFF: Collection of taxes started this morning.  

REPORT OF JAILER: Gave a report to the Fiscal Court of the Inmate Training Facility that is being paid with commissary fund and inmate labor.  

REPORT OF TREASURER:  A) Payment of Claims: General Fund in the amount of $22619.06; Road Fund in the amount of $85892.24; Jail Fund in the amount of $11329.26; LGEA Fund in the amount of $120138.41, Total all Funds $239978.97. Motion to approve payment of claims by Magistrate Welch and seconded by Magistrate Groves. Motion carried.

 

Department Reports: Mike Duncan stated that all tiles have been removed and the 2nd floor remodeling is being done at the Historic Courthouse.

 

Report of Magistrates/Committee: Magistrate Toney stated the Recreation Building and Grounds Committee had met to discuss the inter-local agreement regarding Hopkins County/City of Madisonville dispatch center. County Attorney stated if the agreement was accepted today the County has a 90 day opt-out and the agreement can be adjusted until the April 1 move in date. Motion to approve the agreement with intent to continue negations between now and April 1 by Magistrate Toney and seconded by Magistrate Beshears.   Motion carried.

NEW BUSINESS A) Appoint Keith Cartwright, Jack Morris & Howard Jones to serve on Ethics Board for 2 year terms. Motion to make appointments by Magistrate Beshears and seconded by Magistrate Toney. Motion carried.

 

B) Approve Bids for Hopkins County Scattered Site Housing Rehabilitation Project:

 

 

 

 

Motion to approve bids by Magistrate Beshears and seconded by Magistrate Maurice Wilson. Motion carried.

 

Announcements:  I-69 Conference is being held on Tuesday, October 15, 2013. The regular scheduled Fiscal Court Meeting on Tuesday, October 15, 2013 has been cancelled.   There will be a Special Called Fiscal Court Meeting on Wednesday, October 16, 2013 at 10:00 a.m.

 

Grievances from citizens: Carolyn Foster thank you for helping the south end of the county citizens for the fire protection.

APPROVAL OF MINUTES: October 16, 2013 minutes - Motion by Magistrate Beshears and seconded by Magistrate Toney to approve the October 16, 2013 minutes. Motion carried.  

REPORT OF COUNTY ATTORNEY: McElvain Road – Letter was sent to Countrymark for payment of repair work.

 

REPORT OF COUNTY CLERK:  Nothing to report.

REPORT OF SHERIFF: At the end of October 76% of Property Taxes has been collected.

REPORT OF JAILER: Update on Inmate Training Facility.  

REPORT OF TREASURER:  A) Payment of Claims: General Fund in the amount of $35506.53; Road Fund in the amount of $124578.62; Jail Fund in the amount of $9568.08; LGEA Fund in the amount of $89992.84, Total all Funds $259646.07. Motion to approve payment of claims by Magistrate Maurice Wilson and seconded by Magistrate Beshears. Motion carried.

 

B) Dental Insurance HRI has offered to reduce rates if we sign a 3 year contract.   Motion to approve to sign 3 year contract by Magistrate Beshears and seconded by Magistrate Welch. Motion carried.

Report of Magistrates/Committee: Recreation, Building & Grounds Committee met at 9:00 a.m. on October 16th to discuss fundraising for Sports Complex.   This did not pass committee.

NEW BUSINESS: A) Resolution 2013-12 – Resolution of Hopkins County Kentucky to realign Bradford Pear Lane – Motion to approve by Magistrate Beshears and seconded by Magistrate Welch. Magistrate Toney recused himself from voting. Motion carried.

 

B) Approve Agreement between Kenwood Corporation and Hopkins County, Kentucky - Motion to approve by Magistrate Beshears and seconded by Magistrate Toney. Motion carried.

 

C) Presentation from Warrior Coal.
