HOPKINS COUNTY FISCAL COURT

REGULAR MEETING

GOVERNMENT CENTER

NOVEMBER 19, 2013 at 10:00 a.m.

 

The Regular Called Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive.   Invocation was given by County Attorney Todd P’Pool.   Roll call was taken and a quorum was established with all Magistrates being present except for Magistrate Beshears.  

APPROVAL OF MINUTES: November 5, 2013 minutes - Motion by Magistrate Maurice Wilson and seconded by Magistrate Toney to approve the November 5, 2013 minutes. Motion carried.  

November 13, 2013 minutes – Motion by Magistrate Groves and seconded by Magistrate Welch to approve the November 13, 2013 minutes. Motion carried.

REPORT OF COUNTY ATTORNEY: County Attorney Todd P’Pool gave an update on the annexation for the South Hopkins Volunteer Fire Districts. A petition was delivered to the County Attorney’s office with the proposed boundaries to annex their Fire District territories.  

 

Magistrate Karol Welch thanked anybody that is helping in this matter.  

 

REPORT OF COUNTY CLERK:  Nothing to report.

REPORT OF SHERIFF: Nothing to report.

REPORT OF JAILER: Nothing to report.  

REPORT OF TREASURER:  A) Transfers: Motion to approve by Magistrate Larry Wilson and seconded by Magistrate Toney. Motion carried.

 

B) Payment of Claims: General Fund in the amount of $17517.75; Road Fund in the amount of $112956.59; Jail Fund in the amount of $65338.29; LGEA Fund in the amount of $122936.85, Total all Funds $318749.48. Motion to approve payment of claims by Magistrate Welch and seconded by Magistrate Groves. Motion carried.

 

C) Treasurer’s Report: Motion to approve Treasurer’s Report by Magistrate Toney and seconded by Magistrate Maurice Wilson. Motion carried.

 

D) Retirement: Senate Bill 2 talks about Pension Spiking which is defined when an employee from one year to the next has an increase of 10% in pay.   Retirement used to be figured at the high five.   Senate Bill 2 states no more allowing an increase to help retirement and if so the County will have to pay the difference. Employees need to understand when an elected official is going out of office they reward employees with an increase so this will not be allowed.   Sick leave will no longer be applied to retirement for anyone hired after January 1, 2013.   Part-time employees do not participate in retirement.

NEW BUSINESS: A) Franchise Agreement – Time Warner Cable Midwest LLC Motion to approve agreement by Magistrate Roberts and seconded by Magistrate Toney. Motion carried.

 

B) Franchise Agreement – Insight Communications Motion to approve agreement by Magistrate Toney and seconded by Magistrate Welch.

Motion carried.

 

C) Memorandum of Agreement – Hopkins County Fiscal Court and Commonwealth of Kentucky’s Finance and Administration Cabinet. GIS Kim Ezell explained that this would be a partner with the State to purchase the data.   Motion to approve agreement by Magistrate Larry Wilson and seconded by Magistrate Groves to approve the Memorandum of Agreement. Motion carried.

 

D) Proposed Deed from Hopkins County Fiscal Court to Hopkins County Board of Education for the Anton School. In 1949 the School System deeded the Anton School to Hopkins County Fiscal Court. The Fiscal Court then issued the bonds and the bonds were paid off in approximately 1962 however the property was never deeded back to the school system.   Motion to approve Judge Executive to sign the Deed on behalf of the Fiscal Court by Magistrate Larry Wilson and seconded by Magistrate Toney. Motion carried.
