HOPKINS COUNTY FISCAL COURT
REGULAR MEETING
GOVERNMENT CENTER
August 6, 2013 at 10:00 a.m.

The Regular Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive.   Invocation was given by County Attorney Todd P’Pool.   Roll call was taken and a quorum was established with all Magistrates being present.  

APPROVAL OF MINUTES:  July 16, 2013 minutes - Motion by Magistrate Beshears and seconded by Magistrate Toney to approve the July 16, 2013 minutes.  Motion carried.   

REPORT OF COUNTY ATTORNEY:  County Attorney Todd P’Pool notified the Court of an issue going on concerning Property Valuation Office.  Walgreens Corporation undertaking litigation across Kentucky and it impact on county government.  The Walgreens trying to change the way commercial property is valued.  Hopkins County has been considered as a test case and Margaret Brown has done an excellent job monitoring this development. This is a State wide issue but will impact local school districts and effect county government around Kentucky.   No action is to be taken just informing the Court of this development.   

REPORT OF COUNTY CLERK:   Nothing to report.

REPORT OF SHERIFF:  A) Approval 2012 Unmined Coal Tax Settlement Motion to approve by Magistrate Larry Wilson and seconded by Magistrate Maurice Wilson.  Motion carried.

B) Approval of Resolution 2013-07 for Sheriff’s Deputy for any new hires of any deputies from this point on from Non-Hazardous to Hazardous Duty Motion to approve by Magistrate Welch and seconded by Magistrate Groves.  Motion carried.

REPORT OF JAILER:  Nothing to report.

REPORT OF TREASURER:  A) Payment of Claims General Fund in the amount of $134581.85; Road Fund in the amount of $75472.73; Jail Fund in the amount of $19312.75; LGEA Fund in the amount of $161415.30, Total all Funds $390782.63.  Motion to approve payment of claims by Magistrate Welch and seconded by Magistrate Toney. Motion carried.

  1. Treasurer’s Report Motion to approve by Magistrate Beshears and seconded by Magistrate Toney.  Motion carried.


Department Reports:  Road Foreman, Jeff Browning gave a report and showed a video of McElvain Road – The road is in bad condition.  Countrymark Drilling has trucks using the road and has previously paid for damages on the road.  Countrymark states they will continue to pay for damages on this road and plan on continuing to use the road.     Our residents are having trouble traveling on the road.    County has postponed paving and Countrymark is asking for us to wait until they are finished but not sure when they will be finished.    County Attorney will discuss the road with Countrymark.   
 
Report of Magistrates/Committee:  Budget Committee met to discuss the allocation of Community Development Funds.  These funds will be presented at the next fiscal court meeting.   

Building & Grounds Committee met to discuss the Joint City and County Dispatch to move in the old courthouse.  A committee will be established and a meeting will be held on Thursday, August 8th at 10:00 a.m.

Old Business:  None

NEW BUSINESS:  A) Appointment of Patricia Wiles to Library.  This appointment will replace Gary Hunt’s appointment and will be for a four year term.  Motion to approve appointment by Magistrate Beshears and seconded by Magistrate Maurice Wilson.  Motion carried.

B) Approve Advertisement for Demolition on abandoned properties.  Motion to approve the advertisement for Demolitions by Magistrate Maurice Wilson and seconded by Magistrate Welch.  Motion carried.

  1. Approve bid received from All-State Ford for Diesel Truck.  The Court received two bids: Worldwide Equipment $75,623.00 and All State Ford in the amount of $63420.20.   Motion to approve bid from All State Ford by Magistrate Larry Wilson and seconded by Magistrate Groves.  Motion carried.
  2. Resolution 2013-08 – A RESOLUTION OF HOPKINS COUNTY, KENTUCKY AUTHORIZING THE JUDGE EXECUTIVE TO ENTER INTO AGREEMENTS BETWEEN HOPKINS COUNTY AND CITIES OF DAWSON SPRINGS, HANSON, NORTONVILLE, WHITE PLAINS, ST. CHARLES, EARLINGTON, NEBO, AND MORTONS GAP, KENTUCKY TO CARRY OUT INSPECTION AND PLAN REVIEWS IN COMPLIANCE WITH KENTUCKY BUILDING CODE; KENTUCKY RESIDENTIAL CODE AS GRANTED BY EXPANDED JURISDICTION AGREEMENT WITH THE DEPARTMENT OF HOUSING, BUILDINGS AND CONSTRUCTION.  – Motion to approve Resolution 2013-08 by Magistrate Welch and second by Magistrate Toney.  Motion carried.
