HOPKINS COUNTY FISCAL COURT, REGULAR MEETING, GOVERNMENT CENTER

May 21, 2013 at 10:00 a.m.

The Regular Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive.   Invocation was given by Shane Browning.   Roll call was taken and a quorum was established with all Magistrates being present.

APPROVAL OF MINUTES: May 7, 2013 minutes - Motion by Magistrate Welch and seconded by Magistrate Groves to approve the May 7, 2013 minutes. Motion carried.  

REPORT OF COUNTY ATTORNEY: Nothing to report.

REPORT OF COUNTY CLERK: Nothing to report.  

REPORT OF SHERIFF: Sheriff Latham was not present – Deputy Crick was present and there was nothing to report.  

                                                             

REPORT OF JAILER: Nothing to report.

REPORT OF TREASURER:  A) Transfers: Motion to approve Transfers by Magistrate Larry Wilson and seconded by Magistrate Welch. Motion carried.

B) Payment of Claims General Fund in the amount of $161017.03; Road Fund in the amount of $29955.09; Jail Fund in the amount of $11450.72; LGEA Fund in the amount of $119362.85, Total all Funds $321785.69. Motion to approve by Magistrate Beshears and seconded by Magistrate Toney. Motion carried.

C) Annual Order Setting Maximum amount for Hopkins County Clerk Deputies and Assistants: Motion to approve Annual Order by Magistrate Beshears and seconded by Magistrate Larry Wilson. Motion carried.

D) Annual Order Setting Maximum amount for Hopkins County Sheriff Deputies and Assistants: Motion to approve Annual Order by Magistrate Beshears and seconded by Magistrate Maurice Wilson. Motion carried.

Department Reports: None

Report of Magistrates/Committee: Building & Grounds Committee met on May 21, 2013 at 9:30 a.m. In this meeting discussion was made concerning a $10,000.00 contribution to the YAA Complex.   Motion by Magistrate Toney to approve this request and seconded by Magistrate Larry Wilson. Motion carried.

Motion by Magistrate Toney to open discussion concerning the bidding process for the sports complex fundraiser, this was seconded by Magistrate Welch. County Attorney stated motion was not required. Magistrates Toney and Welch rescinded their motions.  

Old Business: None

NEW BUSINESS: A) Accept Bids for the following:

Motion to approve all of the above bids by Magistrate Roberts and seconded by Magistrate Beshears. Motion carried.

B) Open & Accept Bids for Air Compressor with Piping & 30,000 pound lift:

C) Appoint Scott Walls to Board of Directors of Hanson Volunteer Fire Department. Motion to approve appointment of Scott Walls by Magistrate Beshears and seconded by Magistrate Welch. Motion carried.

 D) Resolution 2013-02 - Kentucky Community Development Block Grant; Hopkins County Procurement Standards involving funds for the CDBG Project; Residential Anti-displacement and Relocation Assistance Plan of the Housing & Community Development Act – Motion to approve Resolution 2013-02 and all documents relating to Resolution by Magistrate Larry Wilson and seconded by Magistrate Beshears. Motion carried.

E) Discussion for Fundraiser – Contract C has been submitted with Shane Browning in the amount of $142,000.00 and they will continue until they raise at least enough money for the costs of the services.   Shane explained the proposal to the Fiscal Court.

Magistrate Toney made a motion to begin fundraising project.   Judge Carroll stated he needed the authority from the Court to bid or sign the contract.

County Attorney does need to review the contract and will submit his opinion on Bidding at the next Fiscal Court Meeting.   County Attorney stated this is a private company that wants to raise money to put in their pocket.  

Magistrate Toney questioned if the Court can contact the Attorney General for his opinion. County Attorney stated he would provide Magistrate Toney with Attorney General’s number and I will provide an opinion concerning this at the next fiscal court meeting. Magistrate Toney stated he will remove his previous motion and wait until we hear back from County Attorney.

After further discussion a motion was made to place bids for fundraising campaign by Magistrate Toney.

County Attorney stated this is premature basically because Fiscal Court Clerk has outlined to put the item out for bids it has to have specs for the service.   County Attorney advised the court not to have narrow site for this one company – need to have further discussion before it is set out to bid.

Magistrate Larry Wilson seconded Magistrate Toney’s motion to advertise bids for fundraising campaign.

County Attorney – should court precede to advertise bids it is without his advice and stated it is premature.
