HOPKINS COUNTY FISCAL COURT, REGULAR MEETING, GOVERNMENT CENTER

May 7, 2013 at 10:00 a.m.

Public Meeting Notice for the purpose of obtaining citizens comments regarding the possible uses of the County Road Aid and Local Government Economic Assistance Funds.

Upon the absence of Judge/Executive Donald Carroll, motion by Magistrate William E. Groves and seconded by Magistrate Chris Toney to elect Magistrate Larry Wilson as Judge Executive Pro-Tem.

The Regular Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive Pro Tem, Larry Wilson.   Invocation was given by Magistrate Shaun Roberts.   Roll call was taken and a quorum was established with all Magistrates being present.

APPROVAL OF MINUTES: April 16, 2013 minutes - Motion by Magistrate Maurice Wilson and seconded by Magistrate Beshears to approve the April 16, 2013 minutes. Motion carried.  

REPORT OF COUNTY ATTORNEY: Donovan Industries had a meeting with County Attorney 80 to 90 percent of blasting has moved to an underground blasting chamber. They will be totally finished with the chamber within one month.

REPORT OF COUNTY CLERK: Nothing to report.  

REPORT OF SHERIFF: Nothing to report.

                                         

REPORT OF JAILER: Nothing to report.

REPORT OF TREASURER: A) Transfers: Motion to approve Transfers by Magistrate Charlie Beshears and seconded by Magistrate Groves. Motion carried.

B) Payment of Claims General Fund in the amount of $150,887.40; Road Fund in the amount of $79,480.51; Jail Fund in the amount of $70,945.03; LGEA Fund in the amount of $57,213.80, Total all Funds $358,526.74. Motion to approve by Magistrate Beshears and seconded by Magistrate Maurice Wilson. Motion carried.

C) Treasurer’s Report – Motion to approve by Magistrate Beshears and seconded by Magistrate Welch. Motion carried.

D) Ordinance 2013-02 – Second Reading of the Ordinance relating to the annual budget and appropriations. Motion to approve by Magistrate Beshears and

seconded by Magistrate Welch.

Department Reports: Suggested pay rate schedule for Public Works Facility – Motion by Magistrate Welch and seconded by Magistrate Groves. Motion carried.

Report of Magistrates/Committee: Transportation Committee Meeting - postpone the final decision of the Bids until next court meeting.

Old Business: Appointments to the Library Board – Appoint Eric Nance Woehler and Jo Bailey Travis to Hopkins County – Madisonville Public Library Board of Trustees.   Motion to approve

NEW BUSINESS: A) Re-appointment of Ruby Poe as Commissioner/Treasurer of the South Hopkins Water District.   Motion to approve the re-appointment of Ruby Poe by Magistrate M. Wilson and seconded by Magistrate Beshears. Motion carried.

B) Request from Genealogy Society: Betty Cox – spoke to the Court about the purpose of the Hopkins County Genealogical Society and to ask for a request of two data bases in the amount $2500.00. Motion to give $2500.00 out of 2012-2013 budget by Magistrate Welch and seconded by Magistrate Beshears. Motion carried.

C) Request from David Lear - YAA – Clarification YAA ballpark is depleting and needs improving.   Many questions were asked about the Hopkins County Regional Sports Complex. Magistrate Toney invited Mr. Lear to the Building and Grounds Committee Meeting at 11:00 to help answer some of his questions.  Mr. Lear also presented a budget request of $247,000.00 or a partial request of $25,000.00.   Judge Executive Pro-Tem Larry Wilson stated the best thing the court can do today is have the Building and Grounds Committee to meet concerning this request.  

D) Shane Browning – Campaign Proposal for Strategic Development Consultants for Sports Complex – 2 phase – County Attorney has reviewed the contract and he wants the Court to understand the terms – Strategic Development Consultants is asking the court to pay $142,000.00 of which 42,000.00 is paid at the signing of the contract and $14,000.00 a month for seven months beginning with month 4 for 7 consecutive months and there is no guarantee they can raise the money.  The Fiscal Court can go in to closed session for open discussion of potential investors that Strategic Development might have from the survey presented to the Court at a previous court meeting to raise one million dollars.   Judge Executive Pro-Tem asked County Attorney if a contract such as this needs to be bid – Per County Attorney if the Court desires to sign this Contract it is his legal opinion that the Contract should be set out for Bid.   Magistrate Toney stated that the Court will not be voting on accepting this contract today. This action is tabled.

Announcements: Magistrate Charlie Beshears stated that on May 9th First Lady – Jane Beshears will be in Dawson Springs to declare the First Trail Town of Kentucky.
