HOPKINS COUNTY FISCAL COURT, REGULAR MEETING, GOVERNMENT CENTER
February 5, 2013 at 10:00 a.m.

The Special Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive, Donald E. Carroll.   Invocation was given by County Attorney Todd P’Pool.   Roll call was taken and a quorum was established with all Magistrates being present.  

APPROVAL OF MINUTES: January 22, 2013 minutes - Motion by Magistrate Beshears and seconded by Magistrate Maurice Wilson to approve the January 22, 2013 minutes.  Motion carried.   

REPORT OF COUNTY ATTORNEY: Todd P’Pool received a letter from Attorney Tom Springer who represents Joint Planning Commission concerning the 2013-01 ordinance accepting Noble Lane into the County Road System.   County Attorney stated the law prevails on the Hopkins County Fiscal Court who can accept a road without approval of the Hopkins County Joint Planning Commission.   It is the County Attorney’s official written opinion that Hopkins County Fiscal Court can legally proceed with the Ordinance.  

REPORT OF COUNTY CLERK:   Final Settlement– Motion to approve the 2012 Financial Report pending final audit by Magistrate Larry Wilson and seconded by Magistrate Toney.  Motion carried.

REPORT OF SHERIFF:  Fee Account Annual Settlement – Motion to approve by Magistrate Larry Wilson and seconded by Magistrate Maurice Wilson.  Motion carried.

REPORT OF JAILER:  Nothing to report.  

REPORT OF TREASURER: A) Payment of Claims - General Fund in the amount of $32096.18; Road Fund $46438.44; Jail Fund $9591.58; LGEA $47961.92; Total $136088.12.  Motion to approve Payment of Claims by Magistrate Welch and seconded by Magistrate Groves.  Motion carried.

B) Treasurer’s Report:  Motion to approve by Magistrate Beshears and seconded by Magistrate Groves. Motion carried.

Department Reports:  Emergency Management Director Frank Wright stated the entire month of February has been declared by Governor Beshear as Earthquake Awareness Month.
 
Jeff Browning requested permission to apply for the Household Hazardous Waste Management Grant.  Motion to approve by Magistrate Welch and seconded by Magistrate Toney.  Motion carried.

Report of Magistrates/Committee:  None

Old Business:  Reports of Pre Campaign Survey 2012 Final Report for Sports Complex have been delivered to the Fiscal Court.

NEW BUSINESS:  A) Second Reading of Ordinance 2013-01 – Ordinance accepting Noble Lane (formerly N. Lake Drive) into County Road System.   
Motion to approve Ordinance 2013-01 by Magistrate Welch and seconded by Magistrate Larry Wilson.  Magistrate Roberts recused his self from this motion.

B) Pauper Burial – Elizabeth Ann Jackson – Motion to approve Pauper Burial and Payment to Bandy Funeral Home – Motion by Magistrate Beshears and seconded by Magistrate Toney.  Motion carried.

C) Approval to add 3 Way Stop Sign at intersection of Richard Morse Road and Rainwater Lane – Motion by Magistrate L. Wilson and seconded by Magistrate Groves.  Motion carried.

Announcements:  County has received a scattered housing grant in the amount of $1,000,000.00.

CLOSED SESSION:  KRS 61.810(1)(c) B Discussions of proposed or pending litigation against or on behalf of the public agency. Motion to go into closed session by Magistrate Roberts and seconded by Magistrate Welch.  Motion carried.

Motion to come out of closed session by Magistrate Larry Wilson and seconded by Magistrate Maurice Wilson.  Motion carried.
