HOPKINS COUNTY FISCAL COURT, REGULAR MEETING, GOVERNMENT CENTER
December 18, 2012 at 10:00 a.m.

The Regular Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive, Donald E. Carroll.   Invocation was given by County Attorney Todd P’Pool.   Roll call was taken and a quorum was established with all Magistrates being present except for Magistrate Toney.  

APPROVAL OF MINUTES: December 4, 2012 minutes - Motion by Magistrate Beshears and seconded by Magistrate Welch to approve the December 4, 2012 minutes.  Motion carried.   

REPORT OF COUNTY ATTORNEY: Nothing to report.  

REPORT OF COUNTY CLERK:   Nothing to report.

REPORT OF SHERIFF: Nothing to report.

REPORT OF JAILER:  Nothing to report.  

REPORT OF TREASURER: A) Transfers:  Motion to approve transfers by Magistrate Larry Wilson and seconded by Magistrate Groves.  Motion carried.  

B)  Payment of Claims - General Fund in the amount of $31143.59; Road Fund $257764.27; Jail Fund $42240.86; LGEA $50857.22; Total $382005.94.    Motion to approve Payment of Claims by Magistrate Beshears and seconded by Magistrate Welch.   Motion carried.

C) Quarterly Payments:  Motion to approve by Magistrate Beshears and seconded by Magistrate Maurice Wilson.  Motion carried.

D)  Treasurer’s Report:  Motion to approve by Magistrate Larry Wilson and seconded by Magistrate Groves.  Motion carried.

Department Reports:  Frank Wright, Emergency Management Director made 95% on the Emergency Operating Center.  The Center did not make 100% because we do not have a Satellite Phone or a designated staff for Emergency Operating Center.    Magistrate Larry Wilson asked Frank Wright if he thought the communication is adequate and if he would get the costs of Satellite Phone and monthly service for this service.   Frank stated he felt the operation center is adequate for our area and he would get the costs of the satellite phone service.  

Mike Duncan, Community Development Director gave a report of the Public Works Facility and the Animal Shelter and the Old Courthouse.

Report of Magistrates/Committee:  None

Old Business:  None

NEW BUSINESS:  :  A) Resolution 2012-25 – Resolution authorizing the removal of .1 mile of the Richland Cemetery Road from County maintenance.    No motion made.   

Mr. Allen spoke the Court about the closing of this road.  There is a gate there and he is afraid that they will lock the gate and not allow individuals in get in the cemetery.   Per the County Attorney – you cannot gate off or block off a cemetery.  It is illegal to block a cemetery.  Magistrate Maurice Wilson stated that the Duncan’s have no desire to block the cemetery entrance and they are afraid that the County will try and take the property.  Their desire is to leave the Cemetery entrance open.   Magistrate Maurice Wilson stated the cemetery was damaged to some vandalism and I believe that is the reason a gate was put up.  

Motion failed. The .1 mile of Richland Cemetery Road will remain as a County Road.  

B)  Pauper Burial for Alice Lee Irvin – Table this to next meeting.

Adjournment: Motion to adjourn by Magistrate Roberts and seconded by Magistrate Maurice Wilson to adjourn.  Motion carried.
