HOPKINS COUNTY FISCAL COURT, REGULAR MEETING, GOVERNMENT CENTER
November 13, 2012 at 10:00 a.m.

The Regular Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive, Donald E. Carroll.   Invocation was given by County Attorney Todd P’Pool.   Roll call was taken and a quorum was established with all Magistrates being present.

APPROVAL OF MINUTES:  October 16, 2012 minutes - Motion by Magistrate Beshears and seconded by Magistrate Maurice Wilson to approve the October 16, 2012 minutes.  Motion carried.   

REPORT OF COUNTY ATTORNEY:  Nothing to report.

REPORT OF COUNTY CLERK:   Not Present.

REPORT OF SHERIFF: Surplus Equipment – Motion to approve by Magistrate Larry Wilson and seconded by Magistrate Welch.  Motion carried.

REPORT OF JAILER:  Nothing to report.  

REPORT OF TREASURER: A) Transfers:  Motion to approve Transfers by Magistrate Welch and seconded by Magistrate Toney.  Motion carried.

B) Payment of Claims:  General Fund in the amount of $181203.44; Road Fund
$266048.03; Jail Fund $117798.93; LGEA $210739.41; Total $775789.81 -   Motion to approve Payment of Claims by Magistrate Beshears and seconded by Magistrate Groves.   Motion carried.

C)  Treasurer’s Report:  Motion to approve by Magistrate Welch and seconded by Magistrate Beshears.  Motion carried.

D)  Discussion of December Pay Date – Motion to approve to change pay date from the 30th to 31st. Motion to approve by Magistrate Welch and seconded Larry Wilson.  Motion carried.

E)  Starting January 15th all paystubs will be online and will not be mailed out.  

Department Reports:  Jeff Browning, Public Works Director stated the Solid Waste Management Five Year Plan was approved.

Report of Magistrates/Committee:  Recreation Building and Ground Committee Met to rebid electrical work for old courthouse renovation.  Motion to approve the advertisement of the bid by Magistrate Toney and seconded by Magistrate Welch.  Motion carried.

Approve purchase of sewage grinder to be installed at Public Works Building in the amount of 2,785.00.   Motion by Magistrate Toney and seconded by Magistrate Beshears.   Motion carried.

Old Business:  None

NEW BUSINESS:  A) Lake Drive, Nortonville, Kentucky:

•    Review of Letter from Hopkins County Joint Planning Commission expressing concerns regarding the acceptance of the road.   Ted Adkins from Hopkins County Joint Planning Commission spoke to the Court about the road and he does not feel this road meets the specifications of this road because it does not meet the county-wide subdivision regulations.  
   
Discussion:  County Attorney are county road standards for subdivision and county road standards – Ted from Hopkins County Joint Planning Commission stated since the road specifications were adopted in March of 1991 and this drive was constructed in 2005 around the time the property was platted as a minor plat, it would be inaccurate to consider this drive an existing road, alley, easement or passway.   

Public Works Director, Jeff Browning stated it does meet minimum standards for County Road but not for Subdivision requirements.   

No Action Taken on the letter to the Court.

•    First Responder Advisory Board – Petition to rename this road to another name if taken into County Road System.  Tabled


B)  Appointment of Official Custodian of the Public Records for Hopkins County Fiscal Court.    Appoint Kim Blue as Official Custodian by Magistrate L. Wilson and seconded by Magistrate Welch.  Motion carried.

C)  Agreement between Kentucky Transportation Cabinet and Hopkins County for Rural Secondary Fund.  Motion to approve Agreement by Magistrate  Beshears and seconded by Magistrate Welch.  Motion carried.

D) Resolution 2012-23 – Resolution adopting and approving the execution of a Rural Secondary Program Agreement between the Fiscal Court and the Commonwealth of Kentucky Transportation Cabinet.  Motion to approve Resolution 2012-23 by Magistrate C. Toney and seconded by Magistrate Groves. Motion carried.
 
E)  Discussion to have all Regular Fiscal Court Meetings on 1st and 3rd Tuesday of each month at 10:00 a.m.  Motion to approve by Magistrate Welch and seconded by Magistrate Toney.  Motion carried.
