The Regular Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive, Donald E. Carroll.   Invocation was given by Leon Smith.    Roll call was taken and a quorum was established with all Magistrates being present.

APPROVAL OF MINUTES:  September 4, 2012 minutes - Motion by Magistrate Beshears and seconded by Magistrate Welch to approve the September 4, 2012 minutes.  Motion carried.   

REPORT OF COUNTY ATTORNEY:  County Attorney, Todd P’Pool stated that his office will be launching a Traffic Safety Program.  

REPORT OF COUNTY CLERK:   Nothing to report.

REPORT OF SHERIFF:  Nothing to report.  

REPORT OF JAILER:  Surplus of Mowers:

•    Scag VIN #C7101582
Motion to approve the surplus of mowers by Magistrate Larry Wilson and seconded by Magistrate Groves.  Motion carried.

REPORT OF TREASURER: A) Payment of Claims:  General Fund in the amount of $28952.52; Road Fund $315641.14; Jail Fund $53077.24; LGEA $68967.37; Total $466638.27 - Motion to approve Payment of Claims by Magistrate Welch and seconded by Magistrate Toney.   Motion carried.

B) Periodic Payments - Motion to approve by Magistrate L. Wilson and seconded by Magistrate Groves.   Motion carried.

C)  Treasurer’s Report – Motion to approve by Magistrate Beshears and seconded by Magistrate Maurice Wilson.  Motion carried.

Department Reports:  Nothing to report.

Report of Magistrates/Committee:  Transportation Committee met to purchase a Mack Truck for the price of $138,726.00 for Sanitation Department to Collect Recyclables.  Motion to approve the recommendation of the Transportation Committee by Magistrate Roberts and seconded by Magistrate Beshears.  Motion carried.

NEW BUSINESS:  A)   Resolution 2012-22 – Resolution adopting the Hopkins County Solid Waste Management Plan – Motion to approve Resolution 2012-22 by Magistrate Welch and seconded by Magistrate Beshears.  Motion carried.

B)  Executive Order – Official Change of Nisbet Road to McNeely Road – Motion to approve by Magistrate: Maurice Wilson and seconded by Magistrate Beshears.  Motion carried.

C) Reappointment of Ben Spears to West Kentucky Workforce Development Board – Motion to approve by Magistrate L. Wilson and seconded by Magistrate Groves.  Motion carried.

D)  Appointment of Leann Todd Langston to Board of Health Department –Motion to approve by Magistrate Roberts and seconded by Magistrate Beshears.  Motion carried.

14.      Announcements: Certificate of Appreciation Certificates to the following employees:
•    Tiffany Jones - 5 years at Hopkins County Sheriff’s Department
•    Jessica Watts - 5 years at Hopkins County Clerk’s Office
•    Samuel Denny - 10 years at Hopkins County Jail.

15.    Grievances from citizens:   Tim Miller of the UMWA – continue to request to support of the Resolution that he has previously asked for the Court to pass.  He is asking each individual magistrate to sign the resolution on their own.   County Attorney stated that the Magistrates could sign if they wanted on their own individual capacity.

Judge Carroll read a copy of the formal letter of endorsement that was sent to UMWA for the change of venue to support our miners and their families as well as to protect their pensions and health care.

Don Moore apologized to the Judge for his actions at the last Fiscal Court Meeting.
