HOPKINS COUNTY FISCAL COURT, REGULAR MEETING, GOVERNMENT CENTER
August 21, 2012 at 4:00 p.m.

The Regular Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive, Donald E. Carroll.   Invocation was given by Magistrate Larry Wilson. Roll call was taken and a quorum was established with all Magistrates being present except for Magistrate Shaun Roberts.

APPROVAL OF MINUTES:  August 7, 2012 minutes - Motion by Magistrate Beshears and seconded by Magistrate Toney to approve the August 7, 2012 minutes.  Motion carried.   

REPORT OF COUNTY ATTORNEY:  County Attorney, Todd P’Pool was not present and was attending the Kentucky Prosecutor’s Conference.

REPORT OF COUNTY CLERK:   Nothing to report.

REPORT OF SHERIFF:  Nothing to report.  

REPORT OF JAILER:  Nothing to report.

REPORT OF TREASURER:  A) Transfers – Motion to approve Transfers by Magistrate Larry Wilson and seconded by Magistrate Groves.  Motion carried.

B) Payment of Claims:  General Fund in the amount of $54097.18; Road Fund
$256343.34; Jail Fund $9972.91; LGEA $40302.06; Total $360715.49 - Motion to approve Payment of Claims by Magistrate Toney and seconded by Magistrate Welch.   Motion carried.

C) Health Insurance:  Anthem has stated the rates will stay the same as last year - Motion to approve Anthem for County Insurance by Magistrate Welch and second by Magistrate Beshears. Motion carried.

Department Reports:  Nothing to report.

Report of Magistrates/Committee:  Public Safety Committee met to discuss renewing contract with Code Red Weather Alert System – Motion by Magistrate Beshears to allow Judge Carroll to enter into a contract for three years with the first year at the rate of $17,500.00 (this includes Weather Warning); 2nd year at the rate of $22,500.00 (this includes Weather Warning) and 3rd year at the rate of $22,500.00 (plus $4,375.00 for Weather Warning) and also to add a non appropriations clause in the agreement and that the contract may be assumed or transferred by another entity.   This was seconded by Magistrate Larry Wilson.  Motion carried.

NEW BUSINESS:  A)   Second Reading of Ordinance 2012-07 – Amendment to Ordinance 2006-10 in relation to the imposition of a county license fee for local or off site solid waste haulers and solid waste management facilities.   Motion to approve Ordinance 2012-07 by Magistrate Beshears and seconded by Magistrate Welch.

Beshears and seconded by Magistrate M. Wilson.

Motion to approve Ordinance 2012-11 by Magistrate C. Beshears and seconded by Magistrate Welch.

E)  Accept Hopkins County Extension District 2012 Tax Rates.  Motion to approve 2012 Extension District Tax Rates by Magistrate L. Wilson and seconded by Magistrate Groves.  Motion carried.

F)  Approve Pauper Burial for Mary Jean Pleasant – Bandy Funeral Home.   Motion to approve Pauper Burial for Mary Jean Pleasant and payment of $500.00 to Bandy Funeral Home by Magistrate M. Wilson and seconded by Magistrate Welch.  Motion carried.

G)  Approve Pauper Burial for Graylan Brown – Reid Walters Funeral Home Motion to approve Pauper Burial for Graylan Brown and payment of $500.00 to Bandy Funeral Home by Magistrate Beshears and seconded by Magistrate Welch.  Motion carried.

H)  Tim Miller spoke to the Court who represents United Mine Workers and is asking the Court to pass a Universal Resolution Condemning Patriot Coal, Peabody Energy and Arch Coal for their Corporate Greed –  Judge Carroll has requested that the County Attorney to review the Resolution.   Table this motion.  

I) Resolution 2012-21 – Joint Resolution for Hopkins, Muhlenberg, Ohio & Webster County $250,000.00 for Coal Miner Training and Certification Project - Motion by Magistrate L Wilson and seconded by Beshears.  Motion carried.

Announcements:

Grievances from citizens:  Attorney Marc Wells spoke to the Fiscal Court about the Logging Ordinance that the Court has had first reading on at its last meeting.   Their concern over the ordinance is that the it pertains only to the Loggers and there are other trucks that may utilize the roadways that are not registered.
