HOPKINS COUNTY FISCAL COURT, REGULAR MEETING, GOVERNMENT CENTER, July 17, 2012 at 4:00 p.m

The Regular Meeting of the Hopkins County Fiscal Court was held at Hopkins County Government Center and was called to order by Hopkins County Judge Executive, Donald E. Carroll. Invocation was given by Magistrate Larry Wilson. Roll call was taken and a quorum was established with all Magistrates being present.   

APPROVAL OF MINUTES:  June 26, 2012 minutes - Motion by Magistrate Welch and seconded by Magistrate Groves to approve the June 26, 2012 minutes.  Motion carried.   

REPORT OF COUNTY ATTORNEY:  County Attorney, Todd P’Pool was absent but Assistant County Attorney, Lee Riddle was present. – Nothing to report.

REPORT OF COUNTY CLERK:   Nothing to report.

REPORT OF SHERIFF:  A) Approval of the 2011 Additional Bills Tangible Tax Settlement.  Motion to approve by Magistrate Larry Wilson and seconded by Magistrate Groves.  Motion carried.

REPORT OF JAILER:  Jailer Blue requested an increase in inmate housing costs from $30.00 per day to $40.00 per day.   Motion to approve by Magistrate Larry Wilson and seconded by Magistrate Groves.  Motion carried.

REPORT OF TREASURER:  A) Transfers – Motion to approve Transfers by Magistrate Larry Wilson and seconded by Magistrate Welch.  Motion carried.

B) Payment of Claims General Fund in the amount of $131,856.82; Road Fund
$179786.82; Jail Fund $30103.21; LGEA $249120.14; Total $590908.98.  Motion to approve Payment of Claims by Magistrate Toney and seconded by Magistrate Beshears.   Motion carried.

C) Treasurer’s Report:  Motion to approve the Treasurer’s Report by Magistrate Welch and seconded by Magistrate Beshears.  Motion carried.

D) Financial Statement – July 1, 2011-June 30, 2012:  Motion to approve the Financial Reconcilement by Magistrate Larry Wilson and seconded by Maurice Wilson.  Motion carried.

Department Reports:  Jeff Browning requested to surplus the following equipment:

Motion to approve the surplus by Magistrate Larry Wilson and seconded by Magistrate Groves.  Motion carried.

Report of Magistrates/Committee:  Building & Grounds Committee met on July 17, 2012 and approved bids for Old Courthouse Renovation as follows:

•    R & D Electric – Electric Service
•    Prow Brothers – HVAC
•    Prow Brothers - Plumbing
•    REM & Sons – Carpet & Tile
Motion to approve bids by Magistrate Toney and seconded by Magistrate Beshears.  Motion carried.

Accept Downey Construction Bid for Hopkins County Animal Shelter in an amount not to exceed $512,880.68.   Motion to approve bids by Magistrate Toney and seconded by Magistrate Beshears.  Motion carried.

Approve Change Order of $18,079.60 for Public Works Facility.   Motion to approve change order by Magistrate Toney and seconded by Magistrate Larry Wilson.  Motion carried.

Transportation Committee met on July 17, 2012 and discussed the Logging Ordinance.  

Public Safety Committee met on July 16, 2012 to discuss Health Department Tax Increase.

Public Safety Committee met on July 17, 2012 and Chief Cotton from St. Charles Volunteer Fire Department concerned about storm shelters not being registered.

Old Business:  None

NEW BUSINESS:  A) Resolution 2012-20 Resolution of Hopkins County Fiscal Court authorizing Judge Executive to make application and enter into an agreement with the Kentucky Office of Homeland Security (KOHS) for the Hopkins County Interoperative Voice Communication System Project.  Motion to approve Resolution 2012-20 by Magistrate Beshears and seconded by Magistrate Maurice Wilson.  Motion carried.

B)  Ordinance 2012-7 An Amendment to Ordinance 2006-10 in relation to the imposition of a County License Fee for Local or Off Site Solid Waste Haulers and Solid Waste Management Facilities as well as greater than or less than one acre construction, demolition and debris landfills. Motion to approve by Magistrate Beshears and seconded by Magistrate Welch.

C) Ordinance 2012-8 An Ordinance Requiring Loggers to register with Hopkins County Prior to Logging Activity – Shaun Roberts requested that this be tabled to next court meeting.  

D)  Approval of Hopkins County Board of Health Tax Rates.    Jack Morris from Health Department requested an adjustment of 2.60 cents per ten thousand to 3.90 cents per ten thousand for Health Department Tax Increase.  Magistrate Roberts recognizes the value of the program and he stated he thinks we should do what we can to save the school nurse program.   KY School Nurse Program President stated she does agree that the best solution to have a community wide approach, Hopkins County Fiscal Court, HC Board of Health and HC School System.  Dr.  Dan Martin spoke with the Court about how important the school nurse program is

Magistrate Roberts recommended we table this vote so that the Health Board can communicate with the School System to see how much additional money the school system will furnish the Health Department.   


School year is already starting and need a resolution as soon as possible.   It is urgent to make a decision

D)  Pauper Burial – Ranae Sue Monroe - Motion to approve the pauper burial by Magistrate Welch and seconded by Magistrate Toney.  Motion carried.
